SERVICE:
Austria
is not a signer of the Hague Service Convention. Many countries are
signatories to The Hague Service Convention (treaty) that governs service
of process to be effected between participating nations. The formal method in
Austria is LETTERS ROGATORY,
a request from a court in the United States to a court in a foreign country
requesting international judicial assistance related to service of process.
Letters Rogatory service must be used in Austria because they strictly
prohibit, by law, any attempt at service of process by any other method.
The Austrian government considers all other methods of service, including
attempts at service by mail or private process server, illegal and an affront to
Austria's judicial sovereignty leaving all participants subject to arrest and
civil prosecution.
This is the only available method for service in Austria.
Advantage: In effect,
creates a case in the country where the documents are served and makes judgment enforceable. Disadvantage:
Time delay. INFORMAL

This
method is prohibited, by law, in Austria. TRANSLATIONS:
Austria requires the documents to be translated into the official
